Trademark is all about likelihood of confusion, which means the company who spells their name properly, could still come after you. The goal shouldn’t be unique spelling, but a unique name that sets you apart from other companies in your industry. Besides, do you really want to have to spell your name out loud every time you say it for the next several years?
